Abstract EN

Contemporary jurisprudents have studied the issue of Altahseen and Altaqbeeh as if the disagreement was between the People of Speech, following the method of the Contemporary Scholars.

The researcher noticed that their review of the opinions of the Ash’aryah, the Maturidiyyah and the Mu’tazilah needs to be investigated, so the researcher has: 1.

Corrected reviewing the opinions of the People of Thought.

2.

Investigated thoroughly the opinions of the Four Schools of Islamic Jurisprudence.

3.

Gave a just judgment of Aba Alhassan Ala’sh’arie who agreed with Malek, Alshafie, Ahmad and the majority of their followers.

4.

Clarified that Ibn Taymiya has disagreed with the majority of the scholars, be they contemporary or early.

5.

Clarified the mistake of most contemporary scholars in reviewing the opinion of the Maturidiyyah, making sure to get out this issue from the framework of Speech to that of Jurisprudence.

This research has been divided into four chapters; the first is concerned with the meaning of the Husn and the Qubh linguistically and technically; the second is concerned with the opinions of the Scholars in Alhusn and Alqubh Aldhati; the third is concerned with the way to know Alhusn and Alqubh; the fourth is concerned with the comparison of the Maturidiyyah’s opinion with those of the Mu’tazilah and Ibn Taymiyyah.

The researcher has concluded that Alhusn and Alqubh is a matter of thought for early Hanafi, Mu’tazila and Ibn Taymiya.

However, Alhusn and Alqubh is a jurisprudential matter for Ash’aryah, Malekis, Hanablis, Shafi’es and some late Hanafis.

This researched was titled as: “ A jurisprudential, An analytical and A comparative Study of Al-Tahsin and Al-Taqbih in the Four Schools of Islamic Jurisprudence”.
