Abstract EN

This paper addresses the issue of securitization and its position in today's financial and economic crisis.

This is carried out through answering the following question: To what extent can the uses of securitization as a tool to achieve profitability, and a factor to reduce the risks of the various parties? Similarly, to what extent can securitization be responsible for today's financial crisis? This paper proceeds through six questions.

Firstly, the paper defines the securitization process and its evolution.

Secondly, it analyses securitization according to Islamic law.

Thirdly, the paper deliberately questions the legal text of securitization in Algeria in relation to mortgage loans.

Fourthly, my paper addresses the benefits and risks of the securitization activity.

Fifthly and in terms of relationships, the paper articulates how securitization plays a major role in the contemporary financial and economic crisis.

Finally, the paper recommends the need to re-set the foundations of the global financial system.
