كانت العقوبة سابقا تفرض بالنظر لجسامة الجريمة و آثارها المتحققة بغض النظر عن شخصية الجاني أو الظروف التي أحاطت وقت ارتكابه للجريمة سواء كانت ظروف اجتماعية أو نفسية أو عضوية، و لكن بعد ظهور النظريات الفلسفية و السياسة الجنائية الحديثة التي دعت إلى النظر إلى شخصية الجاني قبل إصدار الحكم و تقدير العقوبة، و قد اتجهت اغلب القوانين في دول العالم إلى إعطاء سلطة تقديرية للقاضي قبل إصدار الحكم، مما أدى إلى ظهور مبدأ التفريد القضائي للعقوبة، و لكن ما هو الأصل الفلسفي لهذا المبدأ من خلال إبراز موقف القوانين من هذا الموضوع، و كذلك موقف الفقهاء حول تعريف التفريد القضائي للعقوبة و من ثم بيان الاساس الفلسفي لمبدأ التفريد القضائي و كذلك و قبل أي أمر موقف الشريعة الإسلامية لهذا الموضوع، و بعد ذلك بيان أهم النتائج و التوصيات التي توصل إليها الباحث، هذا ما سيتناوله بحثنا المتواضع.
Abstract EN
The penalty was previously imposed in view of the gravity of the crime and its effects regardless of the identity of the offender or the circumstances surrounding the crime, whether social or psychological or membership, but after a flood of philosophical theories and modern criminal policy, which called to look at the character of the offender before the verdict and the assessment of punishment Most of the laws in the countries of the world tended to give discretion to the judge before the verdict was issued, which led to the collapse of the principle of judicial exclusivity.
