Abstract EN

The rule of (the guardian’s behaviour to the subjects is vested with the interest) is considered as one of the key rules in the chapter of the legal policy, and because of the importance of its implications on individuals’ actions and movement discipline, this paper aims to clarify the concept of this rule and mention some applications related to the quarantine coinciding with COVID-19 epidemic.

It is permissible for the guardian to restrict the use of individuals rights to the extent that safeguards the public interest, as he has the right to intervene in the individuals' affairs and consider the outcomes of their actions if they might harm others or generate corruption, whether this is certainly or suspiciously prohibited in order to ward off their results, resolution of corruption as much as possible and the means leading to it as well.

This is a general intention that must be taken into account in all economic, social and political aspects of the state.

So, it has the authority to enact appropriate laws to fend off the expected harm on individuals and groups, which is embodied by the executive authority in its organizational texts that synchronized with the COVID-19 pandemic.
