Abstract EN

This study examines the Legislative Distinction of the Number Related to Women in Personal Status from a Legal Perspective.

It aims at identifying the nature of this distinction that is achieved for women in these matters through the provisions of Islamic legislation and its rules.

The nature of the legislative distinction represented in determining the duration of a woman's breastfeeding of her child, the period of pregnancy and separation, and the relinquishment of woman as well as determining the woman’s legal duration of women upon divorce and death has been examined.

Then, the nature of identifying and organizing the legal obligations in a woman’s inheritance and the rules and images related to it has been manipulated.

It becomes clear that the legislative distinction of the legal period related to women in personal status clearly affects the provisions related to them, and that this distinction works to achieve the principle of obtaining, preserving and safeguarding the woman’s legitimate rights through legal texts and objective purposes, including Islamic legislation, which leaves no room for doubt, change or even personal desires.

Finally, it has also been found that this legislative distinction is inherently original in the Islamic system itself.

That is to say, the legislative distinction is neither haphazard nor emerging in the Islamic system according to some details referred to in the study.
