The apprehension of the principle of free administration can finally suffer, from the legal point of view, of its double nature, which can obscure its scope.

The free administration of local and regional authorities appears, in fact, twice in the text of the Constitution: it appears in article 136 and 146 (last paragraph), in Title IX devoted to local and regional authorities; but it first appears in Article 34 which determines the area of the law.

These underlines, and postulates, that before being a principle which limits the competence of the legislator, it is first of all a principle which bases this competence.

This primary dimension is robust and proven, it is guaranteed without weakening by case law and that of the Constitutional Court.

On the other hand, the second dimension may seem more uncertain, more brittle, less normative.

And this effect of contrast can cloud the tracks and contribute to raising doubts about the firmness and the scope of the principle.

Questioning whether the principle of free administration of local authorities has a normative scope may appear, after the constitutional revision of 2011, to be unnecessarily paradoxical, not to say provocative.

How, indeed, imagine today that a sentence, inscribed in the body of articles 136 and 146 of the Constitution, could remain without legal force? While it is well established that all the standards enshrined in the Constitution or in the texts to which its preamble refers also have constitutional value? The cause is thus heard.

The principle of free administration has full constitutional value and is invested with the resulting legal force.

Where then does one persist in questioning and doubting

L’appréhension du principe de libre administration peut enfin souffrir, au plan juridique, de sa double nature, qui peut en obscurcir la portée.

La libre administration des collectivités territoriales apparaît, en effet, deux fois dans le texte de la Constitution : il figure à l’article 136 et 146 (dernier alinéa), dans le Titre IX consacré aux collectivités territoriales ; mais il apparaît d’abord à l’article 34 qui détermine le domaine de la loi.

Ce qui souligne, et postule, qu’avant d’être un principe qui limite la compétence du législateur, il est d’abord un principe qui fonde cette compétence.

Cette dimension première est robuste et éprouvée, elle est garantie sans faiblir par la jurisprudence et par celle de la Cour constitutionnelle.

En regard, la deuxième dimension peut paraître plus incertaine, plus friable, moins normative.

Et cet effet de contraste peut brouiller les pistes et contribuer à faire douter de la fermeté et de la portée du principe.

S’interroger sur le point de savoir si le principe de libre administration des collectivités territoriales a une portée normative peut apparaître, après la révision constitutionnelle de 2011, comme inutilement paradoxal, pour ne pas dire provocateur.

Comment, en effet, imaginer aujourd’hui, qu’une phrase, inscrite dans le corps même des articles 136 et 146 (dernier alinéa) de la Constitution, pourrait demeurer sans force juridique ? Alors qu’il est bien acquis que toutes les normes inscrites dans la Constitution ou dans les textes auxquels renvoie son préambule ont également valeur constitutionnelle ? La cause est ainsi entendue.

Le principe de libre administration a pleine valeur constitutionnelle et est investi de la force juridique qui en découle.

D’où vient alors que l’on persiste à s’interroger et à douter ?
