Abstract EN

This research searches for the judgment of sharia law on the topic of issuing Bitcoin, and the researcher concluded that the judgment differs between Islamic and non-Islamic states.

All Islamic countries prevent their citizens from the issuance process, and I mentioned that the issuance process is one of the characteristics of the Imam (The Governor) who undertakes it.

Then I have supported this conclusion with the saying of the scholars.

In addition, the Imam has the authority to punishes those who coinage illegally because of the damage that it causes to the entire nation and the corruption of their currency, whether by manipulation or inflammation.

We also have mentioned that the non-Islamic country that prevents its citizens from the issuance process is not different from Islamic countries when it comes to this judgment of Sharia because non-Muslims are addressed by the braches of Sharia.

And its juristic adaptation in these two cases is considered as part of trade.

However, for those countries that allow its citizens to coinage may proceed if the reason of prohibition is lifted, and it would be legally considered as in official currency subject to Zakat and Usury.
