The principle of separation of powers is one of the most important constitutional principles and the most important pillars of the legal state.

One of the most important foundations is the relationship between the public authorities in the state, and what we are interested in talking about is the relationship between the executive and the legislative institution which witnessed constitutional development in the Maghreb constitutions.

As for the mutual means of influence through the relationship between the legislative and executive institutions of the Moroccan constitutions, they are characterized by weak parliamentary oversight tools, the lack of legal penalties imposed by some censorship tools, as well as above the government in submitting bills and restricting the laws proposals submitted by deputies.

Accordingly, the first major concerns that continue to impede the political performance and democratic practice of governance in the Maghreb countries, despite the new amendments or revisions, are the extent to winch constitutionnel rules are applied in practice and the compatibility of the legal system with the constitutional system.
