This study aims to address the issue of fairness in the negotiation of international Contracts in the light of the comparative legal systems.

The importance of fairness in the negotiation increases because of the diversity of the legal and technical issues of negotiation; however, there is are mark able disparity between comparative legislations governing the legal provisions that provide for fairness in negotiations, although many judicial approaches support the judicial intervention to establish civil liability
