Abstract EN

This study aims at determining the basis and constitutional position for both independent and executive organization, determining the field of each one as well as the extent to which they are subject to constitutional and judicial control as they are considered the main and important guarantee for the principle of legality and respect of law.

After research, analysis and discussion that have been carried out, a set of findings are reached.

The study proved that independent and executive organization have a crucial constitutional position that is parallel to the legislative one and that the Algerian legal system cannot abandon such legal rules for the role they play in exercising organizational power.

The study results also in the effect of an overly broad expansion of the field of both organizations in the absence of real regulations that limit this field, and the shortcomings that the constitutional and judicial control suffer from on both organizations ; either at the level of the text or the practice, without forgetting the excessive intervention of the president in the competence of the prime minister to issue executive regulations.
