الترجمات الأربع محل الدراسة النقدية في هذا المقال هي ترجمات تمت بين نظامين قانونيين مختلفين هما نظام القانون المدني (و يعرف أيضا بالعائلة الرومانية الجرمانية) و نظام القانون العام.
يكمن الهدف من الدراسة إبراز الصعوبات التي تعتري ترجمة مصطلحات الحقوق العينية التبعية إلى الإنكليزية.
و تبرز الدراسة مدى تعقد المفاهيم القانونية و تباينها بين هذين النظامين القانونيين في مجال الحقوق العينية التبعية وكيف أن الترجمات في الغالب إما تضع مكافئات وظيفية غير دقيقة أو تجتهد في وضع مقابلات كثيرا ما لا تفي بالغرض أو تترجم المعنى اللغوي على حساب المعنى القانوني المنشود.
Abstract EN
The four translations criticized in this paper were done between two different legal systems, namely from Civil Law into Common Law.
The aim of the paper is to scrutinize the challenges and risks hampering the rendition of the terms of accessory in rem securities into English.
The paper shows how complex and congruent the concepts of accessory in rem securities are between these two systems, and that the translations either supply a partially functional equivalent, or strive to come up with equivalents that do not efficiently convey the notion of the term, or furnish a readily linguistic meaning of the term to the detriment of its legal meaning.

Les quatre traductions, faisant l’objet de l’étude critique dans cet article, ont été réalisées entre deux systèmes juridiques différents, à savoir le droit romano-germanique et la Common Law.
L’étude vise à mettre en évidence les difficultés et les enjeux entravant la traduction des termes des sûretés réelles accessoires vers l’anglais.
L’étude démontre que les concepts juridiques des droits réels accessoires sont complexes et incongrus entre ces deux systèmes, et que les traductions donnent soit un équivalent fonctionnel non - exact, soit s’efforcent de donner des équivalents approximatifs qui ne rendent pas précisément la notion du terme en question, soit se contentent de donner un sens courant du terme au détriment de son sens juridique.
