إن فتح المجال للأشخاص المعنوية العامة للتحكيم في منازعات تنفيذ الصفقات العمومية الدولية يعد تحولا هاما في النظام القانوني لحل المنازعات عن طريق الوسائل البديلة و يعد ضمانة قانونية لتشجيع المتعاملين الأجانب على المشاركة في الصفقات العمومية التي تبرمها الدولة الجزائرية بمختلف هيئاتها لتجسيد المشاريع سيما الكبرى منها بغية تطوير الاقتصاد الوطني.
Abstract EN
The opening of arbitration of disputes arising from the implementation of international public procurements to public law entities is considered to be a significant change in the legal system in the resolution of disputes using alternative methods.
This opening constitutes also a legal guarantee encouraging foreign operators to participate in public procurements concluded by the Algerian State with its various bodies in order to implement projects, especially major ones, with the aim of developing the national economy.

L’ouvrage de l’arbitrage en matière de conflits nés de l’exécution des marchés publics internationaux aux personnes morales de droit public, est considéré comme un changement significatif dans le système juridique de règlement des litiges par des modes alternatifs.
Cette ouverture constitue également une garantie légale encourageant les opérateurs étrangers à participer aux marchés publics conclus par l’Etat algérien avec des différents organes, pour concrétiser des projets, et en particulier les projets majeurs, dans le but de développer l’économie nationale.
