تعد مسألة إيقاع الطلاق بالإرادة المنفردة للرجل إحدى أكثر المسائل إثارة للجدل بين الفقه الإسلامي التقليدي و التجديدي و الفكر الحداثي و إلى هذا المبدأ سار قانون الأسرة الجزائري كمثله من قوانين الأحوال الشخصية العربية في تنظيم حل الرابطة الزوجية أسوة بنظام الطلاق في الشريعة الاسلامية إذ يعد الطلاق الانفرادي من قبل الزوج وفق ضوابطه الأصل في إنهاء الزواج دون استلزام رقابة القضاء عليه أو قيود تمنع إيقاعه أو اشتراط إقراره غير أن هذه المسألة شهدت اعتراضات في العصر الحديث ظهرت إبان حركة التقنين التي شهدتها الأنظمة القانونية العربية و استمرت إلى يومنا هذا تزعمها تيارين مختلفين من حيث المرجعية و إن كانت تشترك في الأهداف و اقتراح حلول لسلب هذا الحق من الرجل و إسناده إلى القضاء لذلك سنناقش من خلال هذه الورقة البحثية الاعتراضات و الحجج الفقهية و الشخصية لجانب من الفقه المعاصر و كذا حجج الفكر الحداثي الذي تبنى مرجعيات الحركات النسوية و مبادئ القانون الدولي لحقوق الانسان مع استنباط موقف المشرع الجزائري و تشريعات عربية قيدت حق الطلاق
Abstract EN
The issue of divorce by the sole will of man is one of the most controversial issues between the traditional and innovative Islamic jurisprudence and also the Modernist doctrine.
To this prin ciple, the Algerian family law like other Arabic personal status laws regulated the dissolution of marriage according to the divorce system in Islamic law.
but however, this issue witnessed objections in second half of Twentieth century, Led by two different currents in terms of refere nces, although they share the same objectives and propose to limit the right of man to divorce.
so, we will stand and discuss through this research paper the objections, doctrinal and personal argu ments of a part of contemporary jurisprud-ence, and to the arguments of the modernist doctrine which adopted the references of feminist move ment and the principles of the international hum an rights law.
also we will devise the pos-ition of the Algerian legislator, and Arabic legislations who has restricted the right to divorce.

La question du divorce par la seule volonté de l’homme est l’une des questions les plus controve rsées entre la jurisprudence islamique et tradition nelle innovatrice et la pensée moderniste.
Confor mément à ce principe, le code algérien de la famille à l'instar d'autres codes arabes du statut personnel, régissait la dissolution du lien matrimonial de la même manière que le système de divorce en loi islamique, qui considère que le divorce par la seule volonté du mari, est l’origine pour mettre fin à cette relation.
Cependant, cette question a fait l'objet d'une objection.
Apparue au début de Codification de la législation arabes, sous l'impulsion de deux courants différents en termes de référence, et proposent des solutions pour priver le droit du mari au divorce.
Nous proposons à travers cet article sur les objections et les arguments de la jurisprudence contemporaine, ainsi qu’aux arguments de la pensée moderne, tout en définissant la position du législateur algérien, et des législations arabes limitant le droit au divorce.
