لقد انتقل العالم المتقدم بأفراده إلى درجة استغلال عالم افتراضي لتلبية حاجياتهم و لكن اكتشف عجز المنظومة القانونية في مواكبة هذا التطور التكنولوجي فبرزت إشكالات عديدة منها ما يستهدف الاعتداء على خصوصية المستهلك الإلكتروني و التي ألزمت المشرع بوجوب توفير الحماية القانونية لهذا الأخير فقد أصبح من السهل جدا أن يقع ضحية خرق أمنه و معلوماته الخاصة التي قد يقدمها و هو على اعتقاد تام أنه يبرم عقدا إلكترونيا أو يرد على عرض تجاري مغري أو حتى حينما يزيل رسالة إلكترونية غير مرغوب فيها ما دفع بالجهود لضبط هذا الاعتداء بالحظر القانوني

The developed world has moved to the point of exploiting a virtual world to meet their needs.
However, it has discovered the inability of the legal system to cope with this technological development, It is very easy to be a victim of a breach of his security and personal information that he may provide, He is fully convinced that he is entering into an electronic contract or responding to an attractive commercial offer or even removing an unwanted e-mail.

Le monde développé est sur le point d'exploiter un monde virtuel pour répondre à leurs besoins, mais il a découvert l'incapacité du système juridique de faire face à ce développement technologique.
Il est très facile d'être victime d'une atteinte à sa sécurité et à ses informations personnelles qu'il est susceptible de fournir: il est pleinement convaincu qu'il conclut un contrat électronique, répond à une offre commerciale attrayante ou même supprime un courrier électronique indésirable.
