Islamic law concentrates of the family and its structure since the beginning of Islamic history, and the issue of childbearing has given special attention to preservation, protection, prevention and treatment, and in light of the scientific and medical development that the world is witnessing today in dealing with childbearing issues and related issues, we have many emerging calamities as a cure to determine the gender of the fetus and other the issues that required the scholars to stand at it to explain the legal ruling for it according to the glorious Islamic Sharia curricula.

The researcher in this research studied the issue of determining the gender of the fetus, a fundamentalist jurisprudential study, by clarifying the opinions of scholars on this issue and the reason for their difference in its rulings, then sympathy for the evidence of each team and clarifying the significance of the evidence from it up to the correct opinion, and this treatment of this topic came from During the presentation of that disagreement according to the Islamic jurisprudence rules to show the extent of the impact of those rules on the jurisprudential dispute rule the matter.
