يعتبر العقد الإلكتروني وليد التقدم التقني في مجال الاتصالات، و هو لا يختلف عن العقد التقليدي إلا في الوسيلة التي يتم إبرامه بها، و هي وسيلة إلكترونية اقتضت طبيعتها التقنية ضرورة إيجاد تنظيم تشريعي خاص بها تراعي فيه هذه الطبيعة، و يقر لهذا النوع من العقود بالاعتراف القانوني و القضائي.
و قد اتبعت المنهج التحليلي المقارن في تناولي لموضوع الدراسة، كما قسمت الدراسة إلى فصل تمهيدي و بابين، و قد توصلت في نهاية الدراسة إلى عدة توصيات، كان من أهمها : دعوة الدول العربية التي لديها فراغ تشريعي إلى ضرورة إصدار تشريع خاص بالمعاملات و التجارة الإلكترونية يشتمل على قواعد خاصة بالتعاقد الإلكتروني، و إلى ضرورة إيجاد بنية تحتية تقنية تساعد على اتساع المعاملات الإلكترونية في الدول العربية، و العمل على إعداد معاهد عربية لتنظيم المعاملات الإلكترونية في إطار قانوني عربي على غرار الاتحاد الأوروبي، و تعديل قانون المعاملات الإلكترونية الإماراتي بحيث يشتمل على نصوص خاصة بحماية المستهلك الإلكتروني، و تنظيم وسائل الدفع الإلكترونية، و حماية البيانات الشخصية للمتعاقد، و تنظيم أسماء الدومين و حمايتها.
