Arabic Abstract

تعد القرارات الإدارية من أهم الوسائل القانونية التي وضعها المشرع بين يدي الإدارة للقيام بأعبائها و وظائفها و تهدف تحقيق المنفعة العامة وخدمة للجمهور، إذ أن القرار الإداري من أكثر وسائل الإدارة شيوعا و استعمالا على المستوى العملي ويتجه العالم أجمع في ظل الوضع الراهن بسبب جائحة كورونا إلى استخدام التكنولوجيا الحديثة في إنجاز الكثير من المعاملات عبر مواقع المؤسسات الحكومية و الحكومة الإلكترونية حيث تناولت دراستي موضوع القرار الإداري الإلكتروني باعتباره ثمرة التطور الهائل في التقدم التكنولوجي في الوقت الحاضر و لا يوجد في التشريعات ما يمنع الإدارة من التعبير عن إرادتها باستخدام الوسائل التكنولوجية الحديثة، فالمشرع لم يشترط في صدور القرار أن يكون مكتوبا أو شفهيا، فالنصوص القانونية تستوعب أن يصدر القرار إلكترونيا، متى ما تم مراعاة تحقق أركان القرار الإداري ونظرا لأهمية القرار الإداري إذ يعد أهم وسيلة قانونية تعبر فيه الإدارة العامة عن إرادتها ويعتبر هذا القرار من أهم موضوعات القانون الإداري و الذي يمتاز بالمرونة و التطور، بما يؤهله إلى استيعاب كافة المستجدات في الحياة الإدارية و مع تطور ثورة المعلومات و تقدم وسائل الاتصالات الحديثة، كان من الضروري أن تساير الإدارات الحكومية هذا التطور في مجال القانون الإداري و خصوصا في نشاطاتها، و الذي من سماته الأساسية، المرونة و التطور لاستيعاب المستجدات و أيضا من خلال دراستي تم تحديد مفهوم القرار الإداري الإلكتروني و أسباب الطعن في القرار الإداري الإلكتروني.

English Abstract

Administrative decisions are among the most important legal means that the legislator has put in the hands of the administration to carry out its duties and functions and aim to achieve the public benefit and serve the public, as the administrative decision is one of the most common means of management and is used at the practical level and the whole world is moving in light of the current situation due to the Corona pandemic to the use of modern technology In accomplishing a lot of transactions through the websites of government institutions and e-government, as my study dealt with the subject of the electronic administrative decision as it is the fruit of the tremendous development in technological progress at the present time, and there is nothing in the legislation that prevents the administration from expressing its will using modern technological means, so the legislator did not stipulate the issuance of the decision It must be written or oral, as the legal texts allow for the decision to be issued electronically, whenever the pillars of the administrative decision are taken into consideration and given the importance of the administrative decision as it is the most important legal means in which the public administration expresses its will and this decision is considered one of the most important topics of administrative law, which is characterized by flexibility and development , In a way that qualifies him to absorb all developments in administrative life and with the development of a revolution Information and the advancement of modern means of communication, it was necessary for government departments to keep pace with this development in the field of administrative law
