Arabic Abstract

جاءت هذه الدراسة لمعالجة الاجراءات و الخطوات التي اتخذها المجتمع الدولي و المنظمة الدولية - الامم المتحدة - في توفير الحماية الدولية لحقوق الانسان و الذي أكد ميثاقها على احترام حقوق الانسان مما يجعل تعزيز الحقوق و حمايتها هدفا لمنظمة الامم المتحدة، التي عملت على إيجاد اليات و ضمانات و مواثيق دولية لحماية حقوق الانسان و ضمانها.

و قد تبين من خلال الدراسة مدى فعالية الاليات المتعلقة بالرقابة على احترام حقوق الانسان وما تواجهه الامم المتحدة من صعوبات بسبب التاثيرات السياسية و الضغوط التي تتعرض لها لحماية حقوق الانسان، و فداحة التحديات النابعة من حجم الخروقات التي تواجه حقوق الانسان في مختلف البلدان و مدى فاعلية الاليات و الادوات المستخدمة في مجال الرقابة الدولية لحقوق الانسان و مدى احترام الدول بتعهداتها في نطاق الامم المتحدة.

كما تبين من خلال الدراسة جهود المنظمة الدولية و محاولاتها الجادة لوضع إطار قانوني دولي إلى جانب اليات رصد دولية لحماية تلك الحقوق و ضمانها حتى أصبح مفهوم حقوق الانسان يتمتع بالصفة العالمية و الحماية الدولية من أي انتهاك من خلال تبني المنظمة لمهمة تعزيز الحقوق و ضمانها و جعلها في صلب اختصاص اللجان التابعة لها.

فضلا عن إبرام و اصدار العديد من الاتفاقيات و المعاهدات و الاعلانات التي تؤكد على الزامية احترام و حماية حقوق الانسان و وجوب ضمانها و من خلال ماتم استحداثه من أجهزة جديدة تعنى بشكل مباشر بحماية حقوق الانسان مثل المفوضية السامية الحقوق الانسان و المجلس الدولي لحقوق الانسان.

و كذلك دخول القضاء الجنائي الدولي و بصورة فاعلة لمحاسبة منتهكي حقوق الانسان ( الجرائم ضد الانسانية ).

و خلصت الدراسة الى ان المنظمة الدولية - الامم المتحدة - اعتمدت على حزمة من الاليات والضمانات التي من شأنها رفد حقوق الانسان و تعزيزها، و تمثل ذلك في اجهزة الامم المتحدة ( الجمعية العامة، المفوض السامي مجلس الأمن، محكمة العدل الدولية و الصلاحيات التي تتمتع بها في هذا المجال، و كذلك الضمانات من خلال المواثيق و الاعلانات الدولية لحقوق الانسان او ضمانات الاتفاقيات و اللجان التعاهدية المعنية بحماية حقوق الانسان.

لقد ارسلت الامم المتحدة وعملت على غرس و ابراز توجه ارادة المجتمع الدولي الى جعل مبادئ حقوق الانسان قواعد امره في القانون الدولي العام.

English Abstract

This study came to address the procedures and steps that adopted by the international community and the international organization-the United Nations- In providing international protection for human rights, Which affirmed its charter on respect for human rights, this makes the promotion and protection of rights a goal of the United Nations Organization, Which worked to find mechanisms, guarantees and international conventions to protect and guarantee human rights.

It was found by this study, how effective are the mechanisms related to monitoring respect for human rights, and the difficulties the United Nations is facing due to the political influences and the pressures they are subjected to protect human rights, the severity of the challenges stemming from the size of the violations facing human rights in different countries, and the effectiveness of the mechanisms and tools used in the field of international human rights monitoring to which states respect their obligations within the scope of the United Nations.

As shown by this study, the efforts of the international organization and its serious attempts to develop an international legal framework, In addition to international monitoring mechanisms to protect, and guarantee these rights.

Until the concept of human rights became universal, and saved by the international protection from any violation, by adopting the organization's mission to promote and guarantee rights and ensuring it by making it the core of the competencies of its committees, as well as, many agreements, treaties and declarations have been issued in this respect, which affirms the obligation to respect and protect human rights and that they must be guaranteed.

Through what has been developed of new devices concerned directly with the protection of human rights, for example, the High Commissioner for Human Rights and the International Council for Human Rights, as well as entering the international criminal justice system in an effective way to hold human rights violators accountable (Crimes against humanity).

The study concluded that the international organization - the United Nations - It relied on a package of mechanisms and guarantees that would support and promote human rights, this was represented in the United Nations organs such as: (General Assembly, High Commissioner, Security Council, International Court of Justice) and the powers it enjoys in this field, As well as guarantees through international charters and international declarations of human rights or guarantees of agreements and treaty committees concerned with protecting human rights.

The United Nations has contributed and worked to inculcate and highlight the will of the international community to make human rights principles as effective rules in public international law.
