Arabic Abstract
هدفت الدراسة الى بيان المقصود بالصياغة التشريعية و أهميتها كمكون مهم من مكونات الإدارة الرشيدة، فبينت الإطار المفاهيمي للصياغة التشريعية، من حيث مفهومها و موجباتها و عناصرها و خطواتها و فوائدها و أنواعها و بينت ضوابط الصياغة التشريعية، من حيث الضوابط التي تتطلبها اللغة القانونية و الضوابط التي تفرضها القواعد اللغوية، كما بينت عيوب الصياغة التشريعية، من حيث العيوب الشكلية و الموضوعية.
و توصلت الدراسة الى أن التنوع الضخم في مناحي السلوك الإنساني، و تشعبه في العديد من المجالات شديدة التعقيد و التقدم، و تنامي التحديات التي تواجه العاملين في مجال إعداد التشريعات و صياغتها، جعلت الدولة غير قادرة على ضمان جودة ما يصدر فيها من تشريعات، ما لم تأسس نظاما مؤسسيا يعتمد آلية علمية فنية على درجة عالية من الدقة، يتصدى لمسائل إعداد التشريعات المختلفة و صياغتها و مراجعتها و ضمان جودتها.
English Abstract
The study aimed to clarify what is meant by legislative drafting and its importance as an important component of good governance.
It showed the conceptual framework of legislative drafting, in terms of its concept, obligations, elements, steps, benefits, and types, and showed the controls of legislative drafting, in terms of the controls required by the legal language and the controls imposed by the grammar, as it showed Defects of legislative drafting, in terms of formal and substantive defects.
The study found that the huge diversity in aspects of human behavior, its complexity in many areas of great complexity and progress, and the growing challenges facing workers in the field of preparing and drafting legislation, made the state unable to guarantee the quality of the legislation issued in it, unless it established an institutional system that adopts A scientific and technical mechanism with a high degree of accuracy that addresses the issues of preparing, drafting, reviewing and ensuring the quality of various legislations.
