Abstract EN

The purpose of this research is to identify the arbitrator's power to issue urgent judgments، through three investigations - So that the first topic occurs: the emergence of arbitration and its concept، While the second topic: sources of arbitration expedited، and the position of jurisprudence to determine the jurisdiction of the arbitrator، And the third topic talked about: the position of the legislation to determine the competent authority in the issuance of temporary and arbitrary measures in the field of arbitration، and the position of the judgments of the judiciary from the arbitration expedited.

The research referred to the sources of arbitration expedited in international conventions، and the sources of arbitration expedited in foreign and Arab legislation، And then spoke extensively to the subject of the principle of common jurisdiction between the ordinary judiciary، and the arbitral tribunal for the consideration of urgent requests in Jordanian law and comparative laws Arab and foreign.

This study reached several conclusions، the most important of which is: The judiciary has determined that the existence of an arbitration agreement does not preclude the expeditious jurisdiction of the judiciary to take preventive and precautionary measures، because the urgent judge has a different temporal order than the subject of the dispute.
