The principle of "competence-competence" in the international arbitration is aimed at addressing issues relating to the incompetence of the Court of arbitration raised by the parties in conflict, with a view to obstructing the arbitration agreement or its procedures for its application.

Thanks to the practical benefits of this principle that contributes to the effectiveness of the arbitration system, this rule has been adopted on the international criminal system and has become enshrined in the various statutes of international courts and particulary in the Statute of the International Criminal Court.
