Abstract EN

This study aims to accentuate an accurate issue from jurisprudential research, which would be beneficial for both a scholar and a student of jurisprudence.

It reveals some benefits and advantages of the jurisprudence, given that popular debatable issues have been researched extensively.

What interests the current Islamic researcher is to balance between different evidences that seem to be inconsistent and unequal, ways of removal the facial discrepancy, to combine between two evidences.

If not achieved, to decide to consolidate one of these evidences.

If it is not possible, we would consider from narration or text side for an external matter.

This research entitles as generalization and specialization from one side is related to weighting from text to consider general over special, more specialized issue from general to the most general from them.

Besides, waiting for an external matter.

This research plan contain an introduction and two sections that entail ten requirements that have twelve issues.

The first section is fundamental and theoretical that gives definition of terms, their meaning, and relations.

The second section is practical and jurisprudential in many directions; purity, prayer, pilgrimage, marriage, judiciary, ruling, and penalties, and this reveals the main focus of this research.

The study has concluded with many findings and recommendations.
