Abstract EN

The importance of making foreign investment sanctions is *widely considered as an effective tool in the competing arena for attracting foreign investment to the Kingdom of Saudi Arabia.

It is considered a common strategy and applied by all sectors relating to foreign investment and finance within the economic sector of the Kingdom of Saudi Arabia, either commercial or civil and is intended to raise the standard of living of local citizens.

Introduction of foreign investment to any country generally depends on the sanctions made by the local government, the most important of which are the contractual guarantees which depend upon the agreement by both parties and which should be included in the investment contract.

This type of guarantee attributes its importance to length of time taken to execute the investment contract, making it subject to political, economic or legal changes that affect its implementation and the rights of the investor.

Accordingly, it is important resort to contractual guarantees to maintain the stability of its legal status of the investment.

Do these government sanctions sufficient to resolve the problem of investment in Saudi Arabia? The aims of this research are: to highlight the importance of contractual guarantees intended to attract foreign investment, and *to compare and contrast the investment systems in Saudi Arabia with those of other regional and international investment laws.) This research bases itself on “the descriptive method”; by first, presenting the texts of particular systems the in question, and second, by analyzing them in order to deduce their significance and then finally, by commenting on the texts and systems under scrutiny.

This research also is dependent upon the analytical approach for deconstructing the texts and explaining what they contain so as to arrive at an objective, coherent and *well- structured explanation) of the issues related to the legal guarantees of foreign investment, as well as using the comparative approach in order to distinguish between)the texts within the systems focused upon here and those of similar legislative systems in order to determine those precise elements within the agreement that concur or differ.

The results of this study will illuminate the importance of the government concessions required both to strengthen the local foreign investment climate and also to attract the largest possible foreign investment.

The recommendations made in this report will emphasize the importance of foreign investment and the need for more serious and responsible efforts by both the government legislative and executive bodies to enact laws which are more accessible and that can keep pace with evolving global systems - in constant development, transition and change), and in so doing, have tangible and positive role in assuring the continuous influx of foreign investment.

Ultimately, such a phenomenon cannot but reflect positively on the economic development of The Kingdom of Saudi Arabia, in general.
