Abstract EN

The death penalty is considered one of the most serious and most severe punishments because it loses the most precious value that it tries to preserve.

It is considered the right to life.

Therefore, it is regarded as the foremost deterrent punishment in the past and modern.

It has provoked a serious jurisprudential controversy that has been reflected in some modern legislations of different principles and philosophies, This punishment lacks the possibility of rehabilitation and reform, which are essential elements of sanctions in this age.

This study dealt with the death penalty as a punitive system in two axes: The first dealt with the death penalty between supporters and opponents of its ruleAnd the second presented the position of Islamic law and Algerian legislation of the death penalty.

Finally, the results and conclusions reached through this study were summarized in the conclusion of the research and were supported by some suggestions.
