تبرز أهمية المفاوضات في عقود التجارة الإلكترونية باعتبارها مرحلة سابقة على التعاقد ترتكز على وسائط إلكترونية تهدف لإبرام عقد نهائي خال من العيوب قابل للتنفيذ دون عوائق فضلا على أنه يسمح للأطراف بتبادل المعلومات و إبرام الاتفاقات التحضيرية و التمهيدية الإلكترونية.
مما يقتضي بيان نظامها القانوني و معرفة أهم مبادئها و آثارها

The importance of negotiations in electronic commerce contracts is underlined as a pre-contractual phase based on electronic media aimed at concluding a definitive, flawless and unhindered contract, as well as allowing the parties to exchange information and conclude preparatory and electronic agreements, requiring their legal system and the most important principles and its legal effects
