نحاول في هذه الورقة البحثية دراسة فكرة "الدفع بعدم الدستورية" التي تبناها المؤسس الدستوري الجزائري من خلال تحليل المادة 188 من التعديل الدستوري لسنة 2016، بالإضافة إلى تحليل مضمون القانون العضوي رقم 18-16 المتعلق بشروط و كيفيات تطبيق الدفع بعدم الدستورية في الجزائر، و من خلال تعرفنا على ضوابط العمل بهذه الآلية، نبين طبيعة و خصوصية ممارسة هذا النوع من الرقابة وفق الفلسفة الجديدة للنظام الدستوري الجزائري
Abstract EN
In this research sheet, we try to study the idea of " objection of unconstitutionality " adopted by the Algerian Constitutional Founder trough analyzing Article 188 of the Constitutional Amendment of 2016,.
In addition to the analysis of the content of organic law No.
18-16 that deals with the conditions and modalities for the application of the objection of unconstitutionality in Algeria.
We will show, through the knowledge of the restrictions of the functioning of this mechanism, the nature and the specificity of exercising this type of censorship according to the new philosophy of the Algerian constitutional system.
