Abstract EN

The research paper aims at editing the annotation by Shaykh Abdulrahman Al-Jenturi which was written after the note of his cousin Abdul Ali al-Insalihi al-Jenturi which consisted of issues on al-Istir’aa (divorce under compulsion) at the Maliki scholars.

Shaykh al-Jenturi is a native of Tuat region who surpassed his peers with his knowledge, fatawi and writings in different fields.

Among his works is the mentioned annotation where he was asked on the question of al-Istir’aa (Divorce by Repudiation) by Abi Hafs Umar Ben Abdulkader al-Tinilani al-Tuati.

He was asked about the ruling divorce by repudiation though it is a compensation given the fact that it is permitted only in donations.

He concluded that it is allowed in condition that the witnesses knew the reason of this divorce by compulsion like a lack of respect or recalcitrance.
