يتناول هذا البحث التأصيل لقاعدة فقهية في المذهب المالكي مفادها الحكم بالكراهة على ما ثبت استحبابه شرعا إذا كان مظنة اعتقاد المكلف وجوبه بأن يواظب عليه لدرجة يتصور معها عدم جواز تركه خاصة إذا صدر من مقتدى به في حضرة من الناس.
فقد اعتمد هذا المعنى كثيرا في الفروع الفقهية عند المالكية في باب العبادات حرصا على بيان عدم الوجوب و جواز الترك وصار علة تعلل بها الكراهة و تدور معها و تكمن أهمية هذه القاعدة في الحفاظ على أحكام الشرع من التغيير الذي قد يلحقها في حال تسوية المكلف بين الواجبات و المندوبات اعتقادا و عملا.
Abstract EN
This research deals with a jurisprudential rule in the Maliki school which is: considering what was judged commendable as disliked for fear of believing its obligation, due to the persistence in doing it.
This rule is known in worships’ section in the doctrine, and became a reason of judging acts as disliked, for the sake of keeping the divine laws as revealed and preventing them from the changes that may happened because of the intentions of the worshipers.
