تعتبر الصفقات العمومية و تفويضات المرفق العام من أبرز المواضيع التي تشغل حيزا واسعا من اهتمام رجال القانون و الإدارة و الاقتصاد على السواء وذلك بالنظر إلى الأهمية الكبرى التي يكتسبها هذا الموضوع في الوقت الراهن حيث تصنف ضمن الوسائل القانونية التي تستخدمها الإدارة العامة لتنفيذ البرامج الاقتصادية كما تعد من أهم أوجه إنفاق الأموال العمومية باعتبار أن هذا النوع من العقود عادة ما يتطلب اعتمادات مالية ضخمة.
وكل ذلك يستدعي الموازنة بين المتغيرات الثلاث: الحفاظ على المال العام تنفيذ البرامج الاقتصادية مراعاة حقوق المتعامل الاقتصادي
Abstract EN
Public transactions and General Assembly mandates are among the most important topics of concern to the legal, administrative and economic sectors, given the great importance that this subject currently enjoys.
It is classified as a legal tool used by the General Directorate for the implementation of economic programs.
Is one of the most important aspects of spending public funds, since this type of contract usually requires large financial allocations.
All this calls for a balance between the three variables: preservation of public money, implementation of economic programs, taking into account the economic rights of the client.
