Arabic Abstract

هدفت الدراسة إلى بيان ظاهرة امتناع الادارة عن تنفيذ القرارات القضائية الإدارية الصادرة ضدها، و الكشف عن الأساليب التي تتبعها الإدارة في ذل و الأساليب التي قد تتذرع بها لتبرير إمتناعها، و الأسباب الحقيقـــة التـــي قد تقف وراءه، و مسؤولية الإدارة عن عدم التنفيذ، إذ جاءت الدراسة لإبراز مسؤولية الادارة الناشئة عن مخالفة التزامها بتنفيذ احكام القضاء الاداري و بناء على ذلك توصل الباحث إلى العديد من النتائج و التوصيات و أبرزها إن عدم تنفيذ الأحكام القضائية من أي جهة أو سلطة في الدولة يمثل إخلالا جسيما بمبدأ الفصل بين السلطات و مبدأ استقلال القضاء و احترام أحكامه و تنفيذها الذي هو ركنا جوهريا في أي نظام ديمقراطي، كما تعـــد مخالفة الإدارة لعدم تنفيذ الحكم القضائي تحديا صارخا لهيبــة القضـاء مــن خلال عدم التزامها بحجية الشيء المقضي فيه و لسيادة السلطة التشريعية على أساس رفضها الانصياع للنص القانوني الذي أعلن القاضي الإداري خرقــه مــن قبلها، و أخيرا يوصي الباحــت بتضمين قانون القضاء الأردنـــي رقــم ٢٧ لسنة ٢٠١٤ نص يجيز للقاضي الإداري أن يوجه أوامـــــر إلــــى الإدارة أو أن يستخدم الغرامة التهديدية في مواجهتها لتنفيذ الأحكام القضائية الصادرة عنها، كما يوصي الباحث المشرع بوضع آلية لتطبيق القرارات بكافة صورها و خاصة الجزائية منها و اعتبارها من القضايا المستعجلة.

English Abstract

The study aimed to demonstrate the phenomenon of the administration's failure to implement the administrative judicial decisions issued against it, and to reveal the methods followed by the administration in humiliation and the methods that may be invoked to justify its failure, and the real reasons that may stand behind it, and the administration’s responsibility for non-implementation, as the study came to highlight the responsibility The administration arising from a violation of its commitment to implement the rulings of the administrative judiciary.

Accordingly, the researcher reached many conclusions and recommendations, most notably that the failure to implement judicial rulings from any authority or authority in the state represents a grave breach of the principle of separation of powers and the principle of the independence of the judiciary and respect for its provisions and its implementation which is an essential pillar In any democratic system, the administration’s violation of non-implementation of the judicial ruling is a blatant challenge to the prestige of the judiciary through its lack of commitment to the authority of the judiciary and the supremacy of the legislative authority on the basis of its refusal to submit to the legal text that the administrative judge declared violating before it, and finally the researcher recommends that the Jordanian Judicial Law No.

27 of 2014 a text permitting the administrative judge to direct orders to the administration or to use the threatening fine in facing it to implement the provisions The judiciary issued by it, and the legislator recommends that a mechanism be put in place to implement all kinds of decisions, especially penal ones, and consider them to be urgent cases.
