Arabic Abstract
تناولت هذه الدراسة أثر رضا المضرور بالضرر على حقه بالتعويض في القانون الأردني و يعد رضا المضرور بالضرر تصرفا قانونيا و له اهمية في تحديد الأثر القانوني و له صورتان الرضا بالضرر الحال، و الرضا بالضرر المحتمل.
و قد جاءت هذه الدراسة لتسليط الضوء على نحو من الخصوصية على اثر رضا المضرور بالضرر من جانبين رضا المضرور في عمليات التجميل، و رضا المضرور في الألعاب الرياضية الخطرة, و ماهية الطبيعة القانونية للمسؤولية المدنية عن جراحة التجميل، و الطبيعة القانونية لفكرة قبول المخاطر الرياضية, و ما أثر رضا المضرور بعمليات التجميل و الألعاب الرياضية الخطرة على حقه بالتعويض.
و قد خلصت الدراسة الى ان رضا المضرور بالضرر له اهميته في حق المضرور بالمطالبة بالتعويض عن الضرر الذي اصابة حسب مشروعية و جسامة الضرر, ففي مجال جراحة التجميل يجب ان يكون قبول مخاطر العمل التجميلي مشروعا, و ان لا تكون جسامة الضرر تفوق الغاية من العمل التجميلي, اما في الالعاب الرياضية الخطرة فاذا حدثت الاصابة ضمن قواعد و تعليمات اللعبة فان قبول المضرور بمخاطر اللعبة يعفي الطرف الآخر من المسؤولية اما اذا تجاوز اللاعب قواعد و تعليمات اللعبة فيحق للمضرور المطالبة بالتعويض.
English Abstract
This study deals with the effect of the victim's satisfaction with the harm on his right to compensation in Jordanian law.
The satisfaction of the injured in the harm is a legal act and has importance in determining the legal effect and has two forms: satisfaction with the .present harm, and satisfaction with the potential harm This study came to shed light - in a private way - on the impact of the victim’s satisfaction with harm from two aspects: the victim’s satisfaction in plastic surgery, the victim’s satisfaction in dangerous sports, the legal nature of civil liability for plastic surgery, the legal nature of the idea of accepting sports risks, etc.
The impact of the victim's satisfaction with .plastic surgery and dangerous sports on his right to compensation The study concluded that the satisfaction of the injured with the harm has importance in the right of the injured to claim compensation for the harm that has been injured, according to the legality and severity of the damage.
Dangerous sports, if the injury occurs within the rules and instructions of the game, the acceptance of the injured party to the risks of the game exempts the other party from responsibility.
If the player exceeds the rules and instructions of the game, the injured has the right to claim compensation
