يعتبر عقد البوت (عقد البناء التسيير و نقل الملكية) من الوسائل التي تلجؤ إليها الدولة من أجل تمويل انجاز و تسيير المرافق العامة و تعهد بذلك إلى الخواص الذي يتلقى مقابل ذلك رسوما من المرتفقين و بعد مدة من الزمن يلتزم بنقل ملكية هذا المرفق إلى الدولة.
وقد تناول المشرع الجزائري هذا النوع من العقود عندما سن قانون الصفقات العمومية و تفويضات المرفق العام 15/ 247 و اعتبره من عقود الامتياز.
Abstract EN
The bot contract (the construction contract for the management and transfer of ownership) is considered one of the means used by the state to finance the completion and running of public facilities, and he undertook to do so for the private sector who receives fees from the comrades, and after a period of time he is obliged to transfer the ownership of this facility to the state.
The Algerian legislator dealt with this type of contract when he enacted the Public Procurement Law and Public Facility Delegations 15/247 and considered it a concession contract.
