Registering debts also prevents funds from waste by repudiation or inability to retrieve them.

In addition, registration of debts blocks the way before any disputes in between the involved parties since time may influence a party to the extent that he forgets the amount of debt something which entails going back to the registered debt as a must to know the truth.

Therefore, this research is designed to study certain cases of debt registration by mortgage during and after the contract.

Those cases are studied jurisprudentially in comparison with the Kuwaiti law.

The researcher introduces a simplified explanation of the cases referring to the statements of the jurists and their clues stressing the aspects of reference through discussion and comparison with the Kuwaiti law.

He also highlights the similar aspects as well as the different ones.
