No doubt that marriage is not a physical pleasure or a mankind production process only; it is a sacred relationship, and purity people witness on the earth as well angels on the sky.

Because of the holiness and sanctity of this relationship, this research studies the different views of the Islamic Sharia scholars about the fetus’ recompense.

The scholars’ opinions are different in its legitimacy’s evidences, its judgment, and its amount.

This research aims to discuss their evidences in order to infer the judgments of the fetus’ recompense, as well as it tries to determine the incoherent juridical terms between the linguists and the Islamic Sharia scholars like: Compensation, Fetus, and Alghorah, the dead Fetus in his mother womb, to arrive to the judgments caused by these different views.
