الملخص AR
يمر الحزب السياسي في الجزائر بناء على القانون العضوي رقم 12-04 بمرحلتين أساسيتين و متكاملتين تكون الأولى قبل الحصول على الاعتماد و الثانية بعد الحصول عليه.
فبخصوص المرحلة الأولى و التي تبدأ من تاريخ تقديم طلب الترخيص بعقد المؤتمر التأسيسي إلى غاية منح الاعتماد من الجهة المختصة فخلال هذه الفترة تثور العديد من المنازعات و التي تتحقق في حالات رفض الترخيص بعقد المؤتمر التأسيسي أو رفض تمديد أجل عقد المؤتمر أو توقيف حزب قيد الاعتماد أما فيما يتعلق بالمرحلة الثانية من مسيرة الحزب السياسي و التي تسري بعد نيله لقرار الاعتماد وبداية ممارسة العمل السياسي فأثناء هذه الفترة تنشأ منازعات سواء تلك المتعلقة بالطعن في القرار المتضمن توقيف حزب معتمد و كذلك الطعن في حالة الحل القضائي لحزب سياسي معتمد.
و قد منح المشرع الجزائري لمجلس الدولة دون سواه صلاحية الفصل في هذا النوع من المنازعات بصفته قاضي أول و آخر درجة.
الملخص EN
The political party in Algeria, pursuant the Organic Law N°12-04, passes by two basic and complementary stages, the first one before obtaining accreditation and the second one right after.
The first stage, which begins with the date of submitting the application, for the license to hold the institutional conference; until the granting of accreditation from the competent authority.
During this period many disputes may arise, which takes place in cases of refusal to license the convening of the institutional conference, or refusal to extend the deadline for holding the conference, or to cancel the accreditation.
Regarding the second stage of the political party's march, which takes place after the granting of the accreditation decision, and the beginning of the practice of political activity, during this period disputes arise, whether those related to the appeal of the decision including the cancellation of an accredited party, and those related to recourse in the case of a judicial dissolution of an accredited political party.
The Algerian legislator has granted the State Council only, the power to adjudicate in this type of dispute as a first and last degree judge.
الملخص FRE
Le parti politique en Algérie, en vertu de la loi organique n°12-04, passe par deux étapes fondamentales et complémentaires, la première avant l'obtention de l'accréditation et la seconde intervient immédiatement après.
S’agissant de la première étape, qui commence dès la date de soumission de la demande d’obtention de l’autorisation afin de tenir la conférence institutionnelle ; jusqu'à l'obtention et la délivrance d’un agrément par l'autorité compétente.
Au cours de cette période, de nombreux litiges peuvent survenir en cas de refus d'autoriser la convocation de la conférence institutionnelle, ou le refus de prolonger le délai pour la tenue de la conférence, ou suspendre le parti au cours du processus d’agrément.
En ce qui concerne la deuxième étape de la marche du parti politique qui se déroule après l'octroi de la décision d'accréditation ou d’agrément et l’entame de l’exercice de l'activité politique, des conflits surviennent pendant cette période, qu'ils soient relatifs aux recours concernant la décision portant la suspension d’un parti agréé, et ceux liés au recours en cas de dissolution judiciaire d'un parti politique accrédité.
Le législateur algérien a accordé au seul Conseil d'État le pouvoir de juger dans ce type de litige en tant que juge de premier et de dernier degré.
