Terrorism and the fight against terrorism have become major elements of domestic and international politics, with media firmly on the front lines.

On the one hand, media must provide verifiable information for the public interest, but also, Citizens expect media to give them the exact information without resorting to sensationalism.

On the other hand, National security, the demands of living together all legitimately lead to call for restraint.

Some states have used “terrorism” argument to silence the media and bring disruptive journalists under control.

They have also used the term to incriminate and criminalise legitimate opinions.

The European Court of Human Rights has had the opportunity to judge on a range of issues, most of which concerned with criminal prosecution of journalists because of their coverage of terrorist acts that may be understood as a promotion or assisting to terrorist movements.

While the Court has affirmed the fixed value of freedom of expression, it has judged that specific restrictions may be imposed in case of a real and imminent danger that threatens national security

Les médias sont en première ligne dans la lutte contre le terrorisme ; ils sont interpellés car, d’une part, ils ont l’obligation de fournir des informations vérifiables et dans l’intérêt du public -qui a le droit fondamental d’accès à une information exacte et équilibrée sans verser dans le sensationnel- de l’autre, la sécurité nationale, les exigences du vivreensemble accroissent légitimement les appels à la retenue, ç la modération, voire à la censure.

Certains Etats ont utilisé l’argument du « terrorisme » pour réduire les médias au silence et pour incriminer, voire criminaliser des opinions ou des actions légitimes.

La Cour européenne des droits de l'homme a eu l'occasion de se prononcer sur toute une série de questions, dont la plupart concernaient les poursuites pénales à l'encontre de journalistes en raison de leur couverture d'actes terroristes pouvant être compris comme une promotion ou une assistance aux mouvements terroristes.

Bien que la Cour a affirmé le principe inaliénable de la liberté d'expression, elle a estimé que des restrictions spécifiques pouvaient être imposées en cas de danger réel et imminent qui menace la sécurité nationale.
