الملخص AR
يعد النظام القانوني للصفقات العمومية من أهم الآليات في استغلال و تسيير الأموال العمومية بحيث تتخذه الدولة كأداة إستراتيجية لتنفيذ سياستها الاقتصادية و نظر للارتباط الوثيق للصفقات العمومية بالمال العام جسد المشرع الجزائري عدة نصوص منظمة لإجراءات الإبرام و تنفيذ الصفقة حيث قرر جملة من الآجال الواجب احترامها و الالتزام في تطبيقها من مرحلة إعداد دفتر الشروط إلى غاية المنح النهائي للصفقة و حتى الاستلام النهائي لمشروع الصفقة العمومية.
و الهدف من ذلك هو الحفاظ على المال العام و المصلحة العمومية لغرض إرساء مبادئ المنافسة و المساواة في الوصول للطلبات العمومية و كذا تفادي جرائم منح امتيازات غير مبررة و استغلال النفوذ لمنح الصفقات العمومية.
إن احترام الآجال المقررة في تنظيم الصفقات العمومية و كذا دفتر الشروط العمومية إلزامي على طرفي عقد الصفقة و الإخلال بالالتزامات المتبادلة قد يرتب أثارا سلبية على العلاقة التعاقدية خاصة أن الواقع التطبيقي يبين الكثير من الاختلالات في هذا المجال لا سيما في تسليم المشاريع في أجالها المحددة.

The legal system for public procurement is one of the most important mechanisms in the exploitation and management of public funds, so that the state takes it as a strategic tool to implement its economic policy, and given the close association of public deals with public money, the Algerian legislator has included several texts regulating the procedures for concluding and implementing the deal Where he decided a number of deadlines that must be respected and commitment to implement them from the stage of preparing the book of conditions to the end of the final award of the deal until the final receipt of the draft of the public deal, the first of which is of great importance, in order to preserve public money and the public interest under the pretext of establishing the principles of competition and equality to reach public requests, as well as avoiding the crimes of granting privileges Unjustified and abuse of influence to grant public deals.
Respecting the deadlines established in the organization of public deals, as well as the general book of conditions is mandatory for both parties to the deal, and breach of mutual obligations may have negative effects on the contractual relationship, especially since the implementation reality shows many imbalances in this area, not including in the delivery of projects within their specified periods.

Le régime juridique des marchés publics est considéré, comme l’un des mécanismes les plus importants en matière d’exploitation et de gestion des fonds publics, aussi il est utilisé comme un outil stratégique d’exécution de la politique économique.
Considérant la relation étroite qui relie les contrats des marchés publics avec le trésor publics, le législateur algérien est contraint de prévoir des textes juridiques réglementant les différentes procédures de passation des marchés publics et leurs exécutions, pour cela il à décidé de soumettre ces modes de passation à plusieurs délais à travers ces différents phases, avec l’obligation de se soumettre aux modalités d’exécution des dispositions règlementaires édictées en se sens, et ce dans le souci de préserver des derniers publics.
