الملخص AR

تم اكتشاف فيروس كورونا المستجد (COVID 19) في الصين في ديسمبر 2019 ثم انتشر تدريجيا في العالم بسرعة مذهلة و في 30 يناير 2020 أعلنت منظمة الصحة العالمية على لسان أمينها العام أن الجائحة تمثل حالة طوارئ صحية عامة و تثير القلق على الصعيد الدولي الأمر الذي حث كل الدول على اتخاذ التدابير الوقائية اللازمة للحفاظ على صحة السكان و الحد من تقدم الفيروس.

وفي هذا السياق المتغير فإن استمرار الالتزامات التعاقدية الدولية صعب و مجهد لكل الأطراف إذ تسعى كل منها إلى الوقاية من المخاطر الناتجة عن تفشي الجائحة وتوزيعها بما يتناسب و مصالح كل طرف فتحديد من يتحمل مسؤولية هذه المخاطر ذو أهمية قصوى بالنسبة للمتعاقدين و لا سيما في عقد دولي ينطوي على مصالح التجارة الدولية.

من خلال هذه الدراسة سوف نبحث عن مدى إمكانية الاحتجاج بمفهوم القوة القاهرة أو الهارد شيبHardship من قبل الأطراف المتعاقدة المتأثرة بأزمة COVID 19لطلب الإعفاء الجزئي أو الكلي من المسؤولية عن عدم تنفيذ التزاماتها التعاقدية أمام هيئة تحكيمية أو أمام القضاء.

was discovered in China in December 2019 and has gradually spread around the world at a staggering rate.

On January 30, 2020, the World Health Organization (WHO) announced, through its Secretary-General, that the pandemic is a public health emergency of international concern, urging all States to take the necessary preventive measures to preserve the health of the population and reduce the spread of the virus.

In this changing environment, the maintenance of international contractual obligations is difficult for all parties who seek to prevent and distribute risks in the event of their occurrence.

Highly probable case following the rapid spread of the pandemic.

From this study, we will look at the extent to which the concept of force majeure or Hardship can be invoked by contracting parties affected by the COVID 19 crisis to request partial or total exemption from liability for failure to perform their contractual obligations before an arbitral tribunal or before a tribunal.

الملخص FRE

Découvert en Chine fin 2019, le coronavirus a connu une propagation fulgurante de par le monde et a provoqué un vent de panique mondiale amenant OMS à reconnaitre qu'il constitue une urgence de santé publique de portée internationale.

Dans le but de ralentir sa progression et préserver leurs systèmes de santé, tous les Etats ont eu recours à des mesures préventives allant du confinement à la fermeture des frontières.

De telles mesures ne pouvaient avoir qu'un impact négatif sur l'activité économique en générale, et sur l'exécution des contrats internationaux en particulier.

Car la capacité des contractants à remplir leurs obligations contractuelles s'en trouve affectée.

Notre analyse portera sur la face d'y faire face afin de se soustraire à la responsabilité contractuelle pour non exécution des obligations suite aux effets néfastes de la pandémie; soit par l'invocation de la force majeure ou la théorie de l'imprévision.
