The overlap between international criminal law and international humanitarian law ends up with a great convergence between them to accommodate the first one in what may be one law, as the two laws aim to achieve security and peace for the individual at the global level, and criminal international law criminalizes acts that IHL seeks to criminalize and prohibit.

The purpose of this article, therefore, is to examine the dialectic of the interrelationship between international humanitarian law and international criminal law by clearly defining what the two laws are and the inevitably shaped relationship between them.
