يحاول هذا العمل تحديد التحدي الذي تواجهه أي دولة ساحلية في ممارسة شرطة الملاحة ضمن حدود البحر الإقليمي، باعتبارها واحدة من الشرط البحرية الخاصة.

تتميز الشرطة البحرية بخصوصياتها مقارنة بالشرط البحرية الخاصة الأخرى، مثل شرطة الثروة السمكية و البيئة البحرية و المنارات أو شرطة الجمارك البحرية.

لا تفرض شرطة الملاحة أي التزام دولي محدد للدولة الساحلية.

غير أنه عن تنفيذ سلطاتها المتعلقة بممارسة شرطة الملاحة في بحرها الإقليمي، فإن الدولة الساحلية مطالبة بالوفاء بسلسلة من الالتزامات التي يفرضها القانون الدولي بخصوص ضمان حرية الملاحة، و لا سيما الالتزام باحترام حق السفن الأجنبية في المرور البريء عبر البحر الإقليمي.

و هذا هو السبب في أن الهدف الرئيسي لهذا المقال يتمثل في محاولة إبراز التوازن الواجب الحفاظ عليه بين سيادة الدولة الساحلية في بحرها الإقليمي و حرية الملاحة البحرية الممنوحة للسفن الأجنبية في حدود هذا الفضاء البحري نفسه.

الملخص EN

This work attempts to identify the challenge that any coastal State must overcome in terms of the exercise of the navigation police, within the limits of the territorial sea, as one of the special maritime police.

This maritime police is distinguished by its specificity compared to other special maritime police, such as the fisheries, marine environment, lighthouses and beacons or maritime customs police.

These special policies do not pose any particular international obligation for the coastal state.

On the other hand, when it implements its powers related to the exercise of the navigation police in its territorial sea, the coastal State is required to fulfill a series of obligations dictated by international law to the effect of guarantee freedom of navigation, in particular the obligation to respect the right of foreign vessels to innocent passage through the territorial sea.

This is why the main object of this work is an attempt to highlight the balance to be preserved between the sovereignty of the coastal State in its territorial sea and the freedom of maritime navigation granted to foreign ships within the limits of this same maritime space.

الملخص FRE

Ce travail tente de cerner le défit que doit lever tout Etat côtier en matière d'exercice de la police de la navigation, dans les limites de la mer territoriale, comme l'une des polices spéciales maritimes.

Cette police maritime se distingue par sa spécificité par rapport aux autres polices maritimes spéciales, telles que les polices des pêches, de l'environnement marin, des phares et balises ou des douanes maritimes.

Ces polices spéciales ne posent aucune obligation internationale particulière pour l'Etat côtier.

Par contre, lorsqu'il met en œuvre ses pouvoirs liés à l'exercice de la police de la navigation dans sa mer territoriale, l'Etat côtier est tenu de remplir une série d'obligations dictées par le droit international à l'effet de garantir la liberté de la navigation notamment l'obligation de respecter le droit des navires étrangers au passage inoffensif dans la mer territoriale.

C'est pourquoi, ce travail a pour principal objet une tentative de mettre en exergue l'équilibre devant être préservé entre la souveraineté de l'Etat côtier dans sa mer territoriale et la liberté de la navigation maritime reconnue aux navires étrangers dans les limites de ce même espace maritime.
