The economic regulatory authorities have been considered by the Algerian legislator as an independent body, with a specific administrative nature.

yet it’s completely different from the traditional administrative bodies, which have as the main task to control the economic and financial fields, in accordance to the market economy politic based on the free competition and private initiative.

however in the attempt to find systems and better management for the hydrocarbons and mines, after opening them to the competition, he gave up on this principle when he assigned a commercial character to the agencies in charge of controlling these strategic sectors.

this made the regulatory authorities to have a unique, and distinctive commercial and juridical confidentiality compared to the usual regulatory authorities in administrative law.

Les autorités de régulation économique ont étéconsidérées par le législateur algérien comme des organes indépendants de nature administrative spécifique et différentecomplètement des organes administratifs traditionnels, qui ont pourtâche principale le contrôle de la sphère économique et financière, conformément à la politique d’une économie de marché fondée sur la concurrence libre et l’initiative privée.

Mais, dans le cadre de sa tentativede créer des autorités qui contrôlent les secteurs des hydrocarbures et des mines après les avoir ouverts à la concurrence, il a abandonné ce principe lorsqu’il aattribué un caractère commercial aux agencies chargées du contrôle de ces secteurs stratégiques, ce qui en a fait des autorités de régulation aune confidentialité juridique commercialeunique et distinct des autorités de régulation habituelles en droit administratif.
