Defined by doctrine as liquidated damage, the penal clause stipulated by concretizing the will of the contracting parties and the amount of which will be due in the event of non-performance of the principal obligation, ceases however to be applied in certain circumstances.
This article deals with the conditions for the applicability and inapplicability of the penal clause

Définie par la doctrine comme étant des dommages-intérêts, la clause pénale stipulée dans le contrat en concrétisant la volonté des contractants, et dont le montant sera dû en cas d’inexécution de l’obligation principale, Cesse cependant d’être appliquée dans certaines circonstances.
Cet article traite des conditions d’applicabilité et des cas d’inapplicabilité de la clause pénale.
