The term legal ownership does not exist as much as such in civilist countries, because it would put the notion of patrimony that the theory of Aubry and Rau has defended so well up to now in danger, it is for this reason that the Algerian legislator did not want to start a discussion on this concept during the debates of the bill instituting the management contract in the 1980’s inspired by the common law trust.
Thus, this study would focus on this notion of the legal ownership, providing tangible evidence that the terms used (managed heritage, all or part of the heritage of the latter, etc.) are nothing more than a legal ownership which does not say its name.
الملخص FRE
Le terme de patrimoine d'affectation n'existe pas autant que tel chez les pays civiliste, car il mettrait la notion de patrimoine que la théorie d'Aubry et Rau à si bien défendue jusque là en péril, c'est pour cette raison que le législateur algérien n'a pas voulu entamé une discussion sur cette notion lors des débats du projet de loi instituant le contrat de management dans les années quatre vingt inspiré du trust de la common law.
Ainsi, cette étude mettrait l'accent sur cette notion qu'est le patrimoine d'affectation, apportant les preuves tangibles que les termes utilisés (patrimoine géré, tout ou partie du patrimoine de cette dernière, etc.
) ne sont autres qu'un patrimoine d'affectation qui ne dit pas son nom.
