الملخص العربي

الهدف من الدراسة هو تحديد أحكام التشريع الاردني في حل النزاعات بين اطراف العقد و تحديد التوافق بينهما .

تعتمد الدراسة على الطريقة النوعية و هي اجراء مقابلات معمقه و قد تم ذلك من خلال العديد من المقابلات التي اجريت مع 24 مهندسا من أصل 30 في 20 مشروعا المهندسون الذين الديهم الخبره في المجال الهندسي و التحكيم، بعد ذلك تم استخدام المقارنة التحليلية الوصفيه للأحكام القانونية الصادرة عن فيديك و التشريعات الاردنية للعقد.

أظهرت النتائج اتفاق الاغلبية على وجود اتفاق بين احكام فيديك و التشريعات الاردنية حيث أن فيديك هو السلطة التشريعية للكتاب الاحمر، بعض أهم النتائج المتفق عليها : اللجوء الى الوساطة و التوفيق قبل الذهاب الى التحكيم في المحاكم، و أهمية الالتزام في المدة المحددة المتفق عليها في العقد .

استنتجت الدراسة الى أن التشريع الاردني يتوافق مع فيديك في حل النزاعات بين اطراف العقد، بالإضافة ان عقود فيديك قد صممت لتعطي المهندس صلاحيات واسعة.

تم التوصل الى العديد من التوصيات مثل التركيز على طريقة حل النزاعات باستخدام لوحة تسوية النزاعات، كما أوصت الدراسة الى تعيين المهندسين الذين لديهم القدرة الفنية و التعاقدية و القانونية الإدارة العقد، و توفير الدورات و ورش العمل في تفسير شروط العقد الموحد فيديك لجميع أطراف العقد.

الملخص الإنجليزي

The objective of the study is to identify the provisions of the FIDICs contract and identify the provisions of the Jordanian legislation in resolving disputes between the parties of the contract, and identify the compatibility between them.

The study depends on qualitative method by making deepened interviews, and that was done by many interviews which were made with 24 out of 30 engineers in 20 projects, the engineers who have the experience in the engineering field and the contracting, after the process of the descriptive analytical comparison and analysis of legal provisions issued by FIDIC and Jordanian legislations for contract were used.

The results showed the majority deal that there is agreement between the provisions of FIDIC and Jordanian legislations as FIDIC is the legislature of RED BOOK.

some of the most important agreed results are : using the mediation and conciliation before going to the arbitration in the courts, and the importance of the commitment in the agreed specific duration in the contract.

The study concluded that the Jordanian legislation is compatible with FIDIC in resolving disputes between the parties of the contract, in addition to that the FIDIC contracts have been designed to adopt the role of the engineer with board powers.

Many of recommendations had been reached, such as: it needs to focus on the method of resolving disputes resolution board.

In addition to that, the recommended appointing engineers who have the technical, contractual, legal ability to manage the contract, also providing courses, and workshops in interpreting the terms of the unified contract FIDIC to all parties of the contract.
