الملخص الإنجليزي

This Thesis deals with an important subject of the Penal Code, namely, Guarantee the speed in preliminary investigation and trial procedures, which is one of the most important procedural issues worthies of consideration as an important guarantee of the guarantees of the complainant and for the community as well, to reach the justice to be achieved.

Therefore, the temporal aspect should be taken into account at each stage of the proceedings and in accordance with the nature of the stage and the procedures involved, and in such a way as to enshrine the importance of the speed and its justifications, in a manner that does not contradict the right of the complainant to defend himself and obtain his rights.

Sufficient to prove his innocence, so speed is not required to expedite such procedures at the expense of the rest of the criminal guarantees of the complainant.

The researcher divided this thesis into two chapters, the first chapter dealt with the guarantee of speed in the preliminary investigation stage, The second chapter dealt with the trial stage.

At the end of thesis, the researcher concluded for anumber of results,the most important of which is the difficult to be quick in the preliminary investigation or trial procedures at the expense of ensuring fair trial, and that the the legislator must be subject to substantive and formal controls in the criminal proceedings,which by nature require aperiod of time to terminate the proceedings.In addition, anumber of recommendations have been reached.

The most important of these is that ensuring fair trial within areasonable period of time in accordance with the provisions governing the trial requies the introduction of aspecialized judicial system in criminal and civil matters to identify specialized chambers in penal matters and limit the number of cases awaiting judges.

The first to reach the specialized justice system.
