Various analyzes relating to the law of local authorities, in Morocco as in France, have often focused on historical developments, on institutional relations or on normative production.
Generally, the distribution of competences between the national level and the local level, then between the local authorities between them takes place in theory according to two scenarios.
Either there is a distribution of competences by attribution (legislative or constitutional) of the various policies to the various levels of communities.
Or, all levels of communities benefit from general competence, which allows them to intervene in all areas.
It is true that the first mode of distribution of powers, when the attribution is made at the constitutional level, characterizes federal states.
However, "There is no unitary state in which the distribution of powers between the state and local communities derives directly from the Constitution".
الملخص FRE
Différentes analyses relatives au droit des collectivités territoriales, au Maroc comme en France, ont souvent porté sur les évolutions historiques, sur les rapports institutionnels ou sur la production normative.
Généralement, la répartition des compétences entre le niveau national et le niveau local, puis entre les collectivités territoriales entre elles se déroule en théorie selon deux scénarios.
Soit, il existe une répartition des compétences par attribution (législative ou constitutionnelle) des différentes politiques aux différents échelons de collectivités.
Soit, tous les niveaux de collectivités bénéficient d’une compétence générale, ce qui leur permet d’intervenir indifféremment dans tous les domaines.
Il est vrai que le premier mode de répartition des compétences, lorsque l’attribution est faite au niveau constitutionnel, caractérise les États fédéraux.
Cependant, « Il n’existe aucun État unitaire dans lequel la répartition des compétences entre l’État et les collectivités locales procède directement de la Constitution
