يعتبر التحكيم الرياضي إحدى أهم الطرق البديلة لتسوية المنازعات الرياضية التي تنشأ بين أطراف العلاقة الرياضية، و قد فرضته الزيادة غير المسبوقة في المنافسات الرياضية التي تشرف عليها الهيئات الرياضية الدولية، القارية، الأولمبية، مما أدى بدوره إلى ظهور نظام فعال و سريع و أرخص كلفة لتسوية هذه المنازعات، هذا من جهة، و يعد الاتفاق الرياضي الحجر الأساسي لخصومة التحكيم الرياضية، و قد تبنت معظم التشريعات الرياضية الدولية و القارية و الوطنية صورتين لهذا لاتفاق، لكي تمنح الأطراف الرياضية المتعاقدة الحق في اللجوء إلى التحكيم من أجل تسوية المنازعات، إذا ثارت بينهما.
من خلال هذا المنطلق يهدف هذا البحث إلى الوقوف على الطبيعة القانونية لاتفاق التحكيم الرياضي من خلال اللوائح التنظيمية التي تصدرها الهيئات الرياضية و مراكز التسوية الرياضية التي أصبحت تنتشر بشكل متزايد عبر العالم، لتصبح محاكم متخصصة في المنازعات الرياضية.

Sports arbitration is one of the most important alternative methods for settling sports disputes that arise between the parties to the sports relationship, and it was imposed by an unprecedented increase in sports competitions supervised by international or Olympic sports bodies, which in turn led to the emergence of an effective, fast, cheaper and more efficient system for settling these disputes.
on the one hand, the sports agreement is the cornerstone of sports arbitration, and most international, continental and national sports legislation has produced two versions of this agreement, in order to give the contracting sports parties the right to resort to arbitration in order to settle disputes, if they arise.
and through this the premise the research aims to identify the legal nature of the sports arbitration agreement through the regulations issued by sports bodies and sports settlement centers, which are increasingly spread across the world, to become specialized courts in sports disputes.
الملخص FRE
L'arbitrage sportif est l'un des modes alternatifs les plus importants de règlement des différends sportifs qui surgissent entre les parties à la relation sportive, et il s'est imposé par une multiplication sans précédent des compétitions sportives encadrées par des instances sportives internationales ou olympiques, qui à son tour a conduit à l'émergence d'un système rapide, moins cher et plus efficace pour régler ces différends.
d'une part, la convention sportive est la pierre angulaire de l'arbitrage sportif, et la plupart des législations sportives internationales, continentales et nationales ont produit deux versions de cette convention, afin de donner aux parties sportives contractantes le droit de recourir à l'arbitrage pour régler les différends.
cette recherche vise à identifier la nature juridique de la convention d'arbitrage sportif à travers les règlements édictés par les instances sportives et les centres de règlement sportif qui se multiplient à travers le monde, et qui deviennent des juridictions spécialisées dans le contentieux sportif.
