رغبة منها في تخفيف الضغط على العاصمة، والتطلع إلى تلبية احتياجاتها من حيث السكن والتجهيزات، تختار السلطات العمومية أحيانا حلولا ملتبسة، لكونها تضحي بأراض فلاحية ضمن برامج طموحة لكنها غير لائقة، كما هو الحال بالنسبة لمدينة بوينان الجديدة.
في هذا الإطار، سلط المشرع الجزائري الضوء من جهة على حماية الأراضي الفلاحية والحفاظ عليها كهدف أساسي في العديد من النصوص، بما في ذلك الصادر سنة 2016 المتعلق بالمراجعة الدستورية، ومن جهة أخرى، على الإطار القانوني عبر مجموعة من النصوص المؤطرة للمدن الجديدة.
في مواجهة هذه الازدواجية، سيتعين على صانع القرار تقييم إسهام هذا المشروع من حيث التنمية الحضرية، موازاة مع تأثيراته على المستوى الفلاحي.
الملخص EN
In order to reduce the pressure on the capital (Algiers), while satisfying its housing and equipment needs, the public authorities sometimes choose inappropriate solutions, sacrificing agricultural land for ambitious but inadequate programs, as in the case of the new town of Bouinan.
indeed, the Algerian legislator has put forward, on the one hand, the protection of this land as a fundamental objective in various texts, including that of 2016 relating to the constitutional revision, and on the other hand, the legal basis through a panoply of texts framing the new towns.
faced with this duality, the decision-maker will be called upon to evaluate the contribution of this project in terms of urban development, in parallel with its impacts on the agrarian plan.
الملخص FRE
Voulant réduire la pression sur la capitale (Alger), tout en satisfaisant ses besoins en habitat et en équipements, les pouvoirs publics optent parfois pour des solutions inappropriées, en sacrifiant des terres agricoles au gré de programmes ambitieux mais inadéquats, à l'instar de la ville nouvelle de Bouinan.
en effet, le législateur algérien a mis en avant d'une part, la protection de ces terres comme objectif fondamental dans divers textes dont celui de 2016 relatif à la révision constitutionnelle, et d'autre part, le socle juridique à travers une panoplie de textes cadrant les villes nouvelles.
devant cette dualité, le décideur sera appelé à évaluer l'apport de ce projet en termes de développement urbain, parallèlement à ses impacts sur le plan agraire.
