Criminality results from the interaction of many, Psychological and social factors and subsequently leads to the emergence of infraction.

Criminality plays an important role in the new punishment system, because the aim of punishment is not only to in¬flict penalty on the convict, but also to correct and rehabilitate him.

Since convicts differ in their Psychological and social circumstances, criminality varies from one to another; and accordingly variation of sanctions should be consid¬ered to realize Justice.

In other words, a sanction that might be just for one convict might not be fair for another.

The revelation of criminality is not an easy task.

It has to follow scientific methods depending on a careful study for the psychological, social, and environmental state of the convict.

Therefore, in order to keep the principal of legality, criminality should be edified by legislative texts which can enable the judge to decide on the convenient sanction or procedure.
