الملخص الإنجليزي

This study represents a modest attempt to explore the issue of judicial review and the role it plays in relation to decisions taken by the public power to refer public employees to retirement and provisional retirement in light of comparative judicial systems, and the Supreme Court of Justice.

This study is divided into three chapters that explore the matter of judicial review on the internal and external elements of the decision to refer Public employees to retirement or provisional retirement under Comparative Judicial Systems and the Supreme Court of Justice.

This study explores and elaborates on all elements independently, this study further explores the legal nature of the referral decisions by reference to relevant definitions and the competent authority.

This study is conducted in a manner that adopts a comparative descriptive analytical method that is, through referring to decisions by the Supreme Court of Justice and Comparative Administrative Judicial systems, in addition to legal texts derived from the Jordanian, Egyptian and French laws.

This study conclude a number of conclusions, recommendations and suggestions that are directly related to Referrals to Retirement and provisional retirement and which are concluded by the researcher as a result of comparing different judicial systems, and court decisions that include French, Jordanian and Egyptian legal systems.
